    Since I've read the original article, I've seem this example closer than I'd like... I've seen many cases, where refactoring would have been the correct solution, but in order not to break user facing code that isn't tested in any automated manner, instead some boolean flag is added to the function.

    Which makes it nearly impossible to understand what is actually happening once there are several of those flags, and makes future changes even more complicated.
